Background:

The current government continues to raise the protection of fair competition in the market to a new level and to promote fair competition among various entities in the market through conducting equal supervision on observance of laws by state-owned enterprises, foreign-owned enterprises and private enterprises. In the last two years, a number of renowned state-owned enterprises and transnational enterprises have been investigated and punished by law enforcement agencies. Enterprises are compelled to meet compliance requirements through enforcement of the law by the Chinese government.

We have invited senior regional legal heads of transnational companies, partners of law firms and former officials of the Industry and Commerce Authority to analyze and discuss various topics such as HR compliance management in enterprises, anti-bribery enforcement and enterprise internal control, etc., in our Enterprise Open Day Activity Special Lecture Series.

Speakers

Host: Dr. Xu Guojian

Dr. Xu Guojian, the managing partner of Boss & Young Attorneys at Law Shanghai Office, graduated from a renowned law school in China and was awarded a doctorate of law by the University of Hamburg in Germany in 1994. With abundant legal service experience at home and abroad, he has provided legal services for numerous domestic large scale enterprises and well-known multinational enterprises, and issued legal expert advisory opinions for domestic judicial authorities and central and local governments. He was invited twice to be a delegate of the government of the PRC to participate in negotiations in international conventions.

Shawn Li

Shawn Li, who joined Johnson & Johnson in the US in 2000, is in charge of the company’s legal affairs in China. He has served as the head of Chinese labor law affairs in Johnson & Johnson. He is also a member of the board of directors. Before joining in Johnson & Johnson, Shawn worked as a senior lawyer respectively in Dorsey & Whitney, Shearman & Sterling, Allen & Overy and other well-known international law firms.

Dr. Iris Duchetsmann

Dr. Iris Duchetsmann is a German lawyer with over 15 years of experience in international business and law. Iris is the managing director of DD Law HR Compliance, where she and her team specialize in international HR management and employment law. Her specific focus lies in supporting clients in international assignments and HR projects, working with employment specialists across Asia Pacific and globally.

Iris has worked in multinational corporations and international law firms in Germany and China. Her clients comprise international companies and executives from various industry sectors, including automotive, energy, transportation, chemical, media, textile, consulting, etc. She has been recognized as a leading lawyer for PRC employment law by Chambers Asia. Iris is a native German speaker, is fluent in English, and has a good command of Mandarin Chinese. She is a frequent speaker and author on

international and national labor law and HR topics.

Shihai Zhang

Shihai Zhang, a former enforcement official in the Shanghai Industry and Commerce Administration Bureau, investigated and heard hundreds of administrative punishment cases including commercial bribery and advertisement. He is familiar with the administrative enforcement process and every phase of enterprise internal control. Zhang Shihai specializes in fields such as anti-bribery, competition law, etc. He maintains up-to-date information regarding administrative enforcement with further research in hot and difficult issues involving anti-bribery enforcement. Some publications by Zhang Shihai include: Selected Cases on Administrative Litigation of Industry and Commerce Punishment (Editor, together with current officials from the Industry and Commerce Bureau, Chinese Industry and Commerce Publisher, August 2014, First Edition), and Analysis and Compliance on Commercial Bribery and Risk of Equipment Placement Behavior (Published in Industry and Commerce Administration, China Industry and Commerce Publisher, 13th Issue).

Anne Yuan

Anne Yuan, the director of the International Department in Boss & Young Attorneys at Law, graduated from Southwest China University of Politics and Law and University of Aberdeen in Scotland with a degree of LLM. She joined Boss & Young Attorneys at Law in 2007 and was recognized as one of 15 best young lawyers in 2014. She has rich experience in the fields of labor law and company compliance, including drafting Chinese compliance documents and enterprise rules for AVL, Liebherr and other multinational companies, as well as providing legal services on compliance, internal investigation and response to government investigation on compliance.
