New Rules for Young Graduates to Work in China

According to a joint Notice issued by the Ministry of Human Resources and Social Security (“MOHRSS”), Ministry of Education and Ministry of Foreign Affairs on 1 January 2017, excellent international graduates may find it easier to start their career in China.

Where previously a two years' work experience was required to obtain a work permit, it will now be possible for certain graduates with a master’s degree or above to work in China without prior working experience.

Which graduates are covered?

The new rules shall apply to foreign graduates with a master’s degree or above from Chinese universities or from well-known foreign universities. However, what will be regarded as such "well-known foreign universities" remains to be clarified. Graduation must have taken place within the previous 1 year.

These foreign graduates are eligible to apply for a Z (working) visa and work permit immediately after graduation.

What are the further requirements?

Foreign graduates must meet the following further requirements in order to work in China:

  • At least 18 years old and in good health;

  • Clean criminal record;

  • Excellent academic performance, with an average grade of not less than 80% or above B/ B+ and a good behavioural record;

  • Corresponding degree and educational background;

  • Confirmed job offer in China to which the degree major is relevant and with salary higher than the local average level;

  • Valid passport or equivalent certificate,

in addition to graduation within the previous 1 year from a Chinese or well-known foreign university.

Which documents need to be provided?

The following documents must be submitted for the authorities’ review:

  • Proof of employment history;

  • Employment offer showing the remuneration;

  • Statement of reason for hiring the foreign graduates (including proof providing that the company has advertised the job to domestic workers for at least 30 days);

  • Proof of health status;

  • Certificate of criminal record;

  • Graduation certificate;

  • Record of good behaviour (for Chinese universities) and grades during education;

  • Recent photo;

  • Employment license or foreign expert work permit. 

After obtaining the Z-visa, foreign graduates will need to obtain the work and residence permit. The initial work permit will be granted for a period of 1 year and upon expiration, it may be renewed for up to 5 years subject to the specific circumstances.

MOHRSS will implement quotas for foreign graduates to be hired amongst different provinces and cities. Quotas will vary from place to place subject to the local demand.
